TERMS OF SERVICE

For the "Вивчай Просто | НМТ" Mobile Application

This Terms of Service Agreement (the "Agreement") is a legally binding contract between Individual Entrepreneur Yehor Fedorov (the "Owner"), registered under the laws of Ukraine, and any individual who downloads, installs, or uses the "Вивчай Просто | НМТ" mobile application (the "User").

1. DEFINITIONS

• 1.1. Application — The "Вивчай Просто | НМТ" software for mobile devices, designed for National Multi-Subject Test (NMT) preparation.
• 1.2. Epoch — A logical stage of the educational course. The first Epoch serves as an introductory period.
• 1.3. Mission — An individual learning level or exercise within an Epoch. The number of Missions within the first Epoch varies by subject according to the curriculum.
• 1.4. Full Access Purchase — A one-time payment providing the User with permanent (lifetime) access to all educational content (all subsequent Epochs and Missions) for the selected subject within the Application.

2. LICENSE AND ACCESS

• 2.1. The Owner grants the User a limited, non-exclusive, non-transferable, and revocable license to use the Application for personal, non-commercial educational purposes.
• 2.2. Access Model:
  • Free Access: The User is granted access to the 1st Epoch of the chosen subject.
  • Premium Access: Access to all subsequent Epochs, Missions, and exam simulators of the selected subject is unlocked upon a one-time purchase.

3. FINANCIAL TERMS AND SUBSCRIPTION

• 3.1. Pricing: The fee for Full Access to the selected subject depends on the platform:
  • Apple App Store (iOS): 19.99 (nineteen dollars and ninety-nine cents) US Dollars (USD).
  • Google Play Store (Android): 959.99 (nine hundred fifty-nine hryvnias and ninety-nine kopiykas) Ukrainian Hryvnias (UAH).
• 3.2. One-Time Payment: This is a one-time purchase that provides permanent access to all content of the purchased subject. There are no recurring fees, auto-renewals, or subscriptions associated with this purchase.
• 3.3. Payment Processing: All transactions are processed through the respective app store platforms (Apple App Store or Google Play Store). The Owner does not store or process any credit card data.
• 3.4. Refund Policy: Since access to digital content is granted immediately upon purchase, the one-time payment is generally non-refundable. Any refund requests must be processed through the official support channels of the Apple App Store or Google Play Store according to their respective policies.

4. INTELLECTUAL PROPERTY

• 4.1. All rights to the Application, including but not limited to: source code, graphic design, audiovisual elements, text tasks, and explanations, are the exclusive property of the Owner.
• 4.2. Proprietary Methods: The Application utilizes unique, proprietary adaptive learning algorithms and an automated error-analysis system based on spaced repetition and gamification methodologies. Any copying, reproduction, or reverse engineering of these algorithms is strictly prohibited and protected under international intellectual property laws.
• 4.3. The name "Вивчай Просто | НМТ" and the associated logo are trademarks of the Owner.

5. USER OBLIGATIONS AND RESTRICTIONS

• 5.1. The User agrees to use the Application only for lawful purposes.
• 5.2. Prohibited Actions:
  • Attempting to gain unauthorized access to the Application’s server infrastructure.
  • Using scripts, bots, or automated tools to complete Missions.
  • Scraping, copying, or distributing educational materials for commercial or competitive use.

6. LIMITATION OF LIABILITY

• 6.1. The Application is provided on an "AS IS" and "AS AVAILABLE" basis. The Owner does not guarantee that the Application will be completely error-free or uninterrupted.
• 6.2. Educational Outcome: The Application is a supplementary study tool. Given the individual nature of learning and varying initial knowledge levels, the Owner does not guarantee any specific score on the NMT or other state exams.
• 6.3. The Owner is not liable for any losses resulting from the User’s loss of access to their account or device.

7. DATA PRIVACY AND ANALYTICS

• 7.1. Personal data processing is conducted in accordance with the Privacy Policy, which is an integral part of this Agreement.
• 7.2. To analyze learning efficiency, the Application utilizes third-party tools (specifically Amplitude) to collect anonymized data regarding the User's progress and interaction patterns.

8. TERMINATION

• 8.1. The Owner reserves the right to suspend or terminate the User’s access to the Application without a refund if the User violates these Terms.
